The use, possession, sale, distribution and production of THC delta-8 obtained from hemp varieties is legal in Virginia. For delta-8 to be federally legal, hemp must contain only up to 0.3% delta-9 THC. Virginia is the latest state to ban delta-8 THC products, with Governor Glenn Youngkin waiting until the last day allowed to pass a bill that also limits the sale of smokable hemp. Solvents used to extract CBD and convert it to delta-8 THC must be removed from the final product before it is ready to be added to gummies, tinctures and vaporizers.
